ALBANY — The New York State Public Service Commission (Commission) will hold a virtual public statement hearing on Thursday, November 21, 2024, regarding Valley Energy, Inc.’s (Valley Energy), petition for authority to amend its franchise in the Town of Chemung, Chemung County.
On April 18, 2024, Valley Energy filed a petition, pursuant to Section 68 of the Public Service Law, seeking an amendment to its Certificate of Public Convenience and Necessity. The requested amendment would enable it to provide extraterritorial service, pursuant to its franchise agreement with the Town of Chemung, Chemung County. Valley Energy proposes the construction of pipeline and interconnection facilities that will accommodate the gas generated from a proposed landfill renewable natural gas project to be built by WB Chemung, LLC.
The interconnection facilities will be constructed adjacent to the Chemung Landfill, and the pipeline will connect the interconnection facilities to Valley Energy’s existing service area at its distribution pipeline near the Vulcraft steel plant. Valley Energy will receive and transport the gas produced by the project through the interconnection and pipeline infrastructure, and WB Chemung will purchase natural gas for use at the project through a separately installed service line. Valley Energy proposes to construct, within the existing right of way, an approximately 5-mile long, six-inch polyethylene pipeline to connect the project to an existing pipeline near the Vulcraft steel plant entrance located on County Road 60 in the Town of Chemung. The pipeline will be constructed entirely within County Road 60 or on the Chemung Landfill parcel. Valley Energy intends to provide natural gas service to customers along the proposed route.

All participants will be muted upon entry into the hearing. The ALJ will call upon each person who asks to make a statement. The ALJ will continue the hearing until everyone wishing to speak has been heard or other reasonable arrangements to submit comments into the record have been made. Reasonable time limits may be set for each speaker as necessary to afford all attendees an opportunity to be heard. It is recommended that lengthy comments be submitted in writing and summarized for oral presentation. A verbatim transcript of the hearing will be made for inclusion in the record of this case.

The principal purposes of the procedural conference are to identify any potential parties and provide interested persons an opportunity to present and explain any proposals regarding the procedures they believe should be followed in this case by the ALJ and Commission including, but not limited to, whether any issues of fact presented by the petition or public comments warrant an evidentiary hearing. Other procedural issues also may be addressed.
