In a petition filed on March 11, 2026 (Amendment Petition), pursuant to Public Service Law Section 122(4), Empire Wind requests approval to amend Certificate Condition Section I, Part 2 of the Certificate. Specifically, Empire Wind asks to modify the Time of Year Restriction in New York State waters to expand the allowable construction window for the placement of rock protection measures to include three days of seabed disturbing work in April or May 2026. Empire Winds asserts that, if the cable remains unprotected until the existing allowable construction window in the latter part of July 2026, there will be an increased potential for damage to the cable due to snags and anchor strikes, which creates concerns about cable integrity and the safety of waterway users and their equipment.
